MIDGHAM PARISH COUNCIL NEEDS YOU!

Become involved with Midgham’s future! How do you see the future of your village?

Midgham Parish Council has vacancies for new councillors and would love to hear from anyone interested in becoming involved in the running of Midgham. If you have an opinion, want to see things done differently or are able to contribute in any way – your parish needs you! The qualifications are enthusiasm and commitment to local issues. The meetings, held once a month, include discussions re planning issues, maintenance work around the village, flooding issues. liaison with West Berkshire Council plus more. If you want to make your views count, this is the job for you!

Come along and see what’s involved. There is an open invitation to anyone wishing to come along to the monthly meetings of the Parish Council. These are held on the fourth Tuesday of every month in the village hall and start at 7.30 pm. An agenda for the meeting is placed on the Birds Lane notice board. Members of the public are welcome to attend - it is always good to see new faces.

Minutes of the Parish Council meeting held on Tuesday 23 November 2010 in the Village Hall at 7.30pm.

Present were Mr H Long (Chairman)(HL), Mr R Norris (RN)

Mrs I Neill (District Councillor) (IN) Mrs A Spoor (Clerk)
plus 4 members of the public

1. Apologies for absence were received from Mr J Carey (JC) due to other commitments.
2. Declarations of interest – DL declared an interest re 106 monies in respect of the play area as he lives adjacent to the property.
3. Minutes of the previous meeting held on Tuesday 2 November 2010 were approved and signed.
4. Matters arising not on the agenda – no matters arising
5. Resignation of councillor - Mrs M Rusbridge (MR) has resigned from the council. The Chairman paid tribute to the service of MR in recognition of all her hard work. The post does not have to be advertised as we are within the 6 month preceding the next election. If a suitable candidate becomes known it is permissible to co-opt.
6. Toad Hall Sewerage System - Detailed discussion re the request to install a biotech drainage system for Toad Hall on the village green followed. Key points raised were:
- Recognition & thanks to DL & RN for the enormous amount of work undertaken on this proposal
- A BT cable close to the surface was discovered. It was queried if this was legal. BT need to be consulted about repositioning this cable at an acceptable depth. Action TH.
- Tests showed that the porosity of the soil was not sufficient for a soakaway to cope and a biotech system would be the solution. DL felt that increased usage from the property and possible changes in the water table had tipped the balance.
- There is insufficient space within the boundary of the property to accommodate any new system and therefore it would need to be sited on the green. The easiest solution would be to position it as close to the boundary as possible.
- Legal agreements to be drawn up re permission and ongoing maintenance – all costs borne by T Hodges
- Posts to protect the biotech system should be considered and confirmation that the top is childproof is essential
- DL & RN to meet Saturday 27 Nov to inspect cable and agree suitable position for the proposed system
- UKDN will submit documentation to WBC in respect of env. health, building control, licence etc.
- Responsibility for ownership of the ditches raised – Clerk to investigate
- RN surprised building regs not required.
- TN thanked the council for the time spent on this issue.
- DL, RN and Clerk to meet to further discuss giving approval and appointment of a solicitor to act on our behalf. Date to be agreed.

7. Section 106 contributions available 106 Money available £5k in respect of open spaces. These are Midgham Green, Birds Lane garden & play area. Swings/play equipment would be too expensive and liabilities too onerous & inspections too big commitment. Benches/paving/bus shelters suggested. Agreed that members should consider ideas and item be on agenda next meeting.

8. Emergency Plan
- New planning /emergency wards to be agreed
- Public snow clearing directives – note from M Edwards provided to councillors by clerk.
- Aldermaston PC emergency plan too complex – IN offered Tadley Plan as an example to look at – Clerk to circulate.
- IN raised issue of WBC getting details of vulnerable people
- Next steps – draw up a flyer for councillors to distribute in their wards – Clerk to draft and circulate for comments. Discuss at next meeting in January.

9. Village Hall – The Parish Council has received an invitation to appoint a parish councillor as a trustee for Midgham Village Hall Charity. RN is already a member of the Village Hall committee but declared an interest if he were to be the representative as he resides next door to the village hall and there may in the future be an issue of conflict. RN is happy to report back but would like to revisit who should be the representative when the council is at full strength.

10. Midgham Green – maintenance arrangements – HH has obtained a quote but it was agreed to seek an additional quote. HH will action. Public liability insurance must be held by any contractor.

11. District Councillor’s report – copy to be obtained.
12. Nursery Copse Appeal – progress is being made drawing up enforcement notice. Progress will be monitored monthly.

13. West Berkshire Local Transport Plan 2011-2026 Consultation Draft – no comments
14. 2010/11 Highway Winter Service Plan – Consultation – Salt bins – Clerk advised that missing bins and damages to the existing bins had been reported to WBC. No further comments

15. Public Time – Puddle by Keepers Cottage not draining / ditch Inwoods field/Lovells wood – DL/BN will investigate ditches. Drain cover to right of Hill House to be reported by Clerk.

16. Budget and expenditure review - consideration is to be given to setting precept in January.

1. Apologies for absence were received from Mrs I Neill (District Councillor) (IN) due to other commitments.

2. Declarations of interest – None
3. Co-option of new councillors – The resignations of John Goddard and James Ormrod created 2 vacancies on the Council. The Chairman paid tribute to the long service of John Goddard in recognition of all his hard work. Mrs Heather Hutchins and Mr Robert Norris gave brief introductions about themselves – both were unanimously co-opted onto the council. This restores the council to its full quota of 6 councillors. The new councillors were requested to sign the declaration of interests for the register and were invited onto the council for the remainder of the meeting.
Action: Clerk to send note of thanks to John Goddard.

4. Minutes of the previous meeting held on Tuesday 28th September 2010 were approved and signed.

5. Matters arising not on the agenda - none
6. Section 106 contributions - £5000 is available to spend on a Public Open space within the Parish. Suggestions included – play equipment, bench, paved flower beds. Resolved: Clerk to email Councillors inviting ideas and reschedule item for discussion at next meeting.

7. Emergency Plan – Resolved: Clerk to draft new planning and emergency areas including the new councillors and circulate for consideration. Copy Aldermaston Emergency Plan to new counciloors. Reschedule for discussion at next meeting.

8. Village Hall – The Village Hall trustees have formally invited a member of the Parish Council to become a trustee for the Village Hall Charity. R Norris declared that he is already a trustee but was conscious of a conflict of interest.
Resolved: Clerk to email the letter of invitation to all councillors seeking a volunteer.

9. District Councillor’s report – the district councillor was not present – the clerk read a copy of her report.

10. Nursery Copse Appeal – No progress to report – matter still with legal dept at WBC
Action: Clerk to monitor

11. Encroachment into agricultural land in Midgham Park - item c/f from last month’s meeting. The reported areas are: Gardeners Cottage - use of agricultural land as garden; Midgham Park Farm - creation of fenced off gravelled area at top of field; West Lodge - garden extended beyond boundary
• Clerk confirmed that as the item was deferred last month pending establishing more information – The clerk confirmed there had been no contact with WBC enforcement officers by the Parish Council although DL understood that an enforcement officer had visited.
• MR advised that the complaint had been received anonymously,
• DL has spoken to all parties involved and reported his opinion to the Council:
• Gardner’s Cottage – not considered an infringement of planning of residential encroachment into agricultural land. The owners of the property assure it is not their intention to extend the garden.
• Midgham Park Farm – not considered as encroachment more an extension of the paddock improving a pull in area. Erection of a fence does not require planning.
• West Lodge – It is not obvious that there is a breach despite there being more physical evidence of what appears to be agricultural activity. It is hard to determine the actual curtilage of the residential land – it was agreed to ask John Goddard to assist with determining the actual curtilage of the property.

12. Public Time Salt Bins – the additional 2 bins purchased last year have not been returned and the one at the end of Bird’s Lane is not in good repair. Clerk has already reported this
Action: Clerk to chase WBC

A question was raised by a member of the public whether the reporting of the encroachment into agricultural land were all lodged by the same person. MR who had received the initial complaint did not want to add anything except that it was a anonymous complaint.

13. Midgham Green: The proposal in respect of the Toad Hall Sewage system was discussed at length at the Parish Council meeting on 2 November 2011 The key points were as follows:
a) It was agreed that a percolation test on the site to the north east of the footpath is required – this should be undertaken by an independent company not by UKDN to assess if the water table permits a new soakaway that will allow better percolation of the water.
b) Confirmation required that the existing sceptic tank is fully operational –
i) that no chemical/cleaning fluids are being used
ii) proof that the existing tank has been emptied and how frequently this has occurred.
c) Whether the function of the existing tank and soakaway has deteriorated since extending the property and the added conversion of the Garage.
d) Whether surface water is connected to the existing tank or whether a water butt facility is installed to collect excess rainwater.
e) It was felt that if it were possible to install a new tank within the boundary of Toad Hall (subject to distance from properties) that overhead cables could be removed temporarily to allow installation and that this should not serve as a reason why this option should be discounted.
f) If the percolation test on the other side of the path failed then consideration should be made to keeping the existing tank and installing a pump.
g) If the percolation test proved successful then 2 soakaways be considered.
h) All decisions would be subject to West Berkshire Council agreement to discharge into an exposed water gully – this decision is still pending a reply from WBC.
Action: Clerk to draft response to Mr Hodges with outcome of discussion consulting with DL prior to sending

14. Budget and expenditure review – Clerk circulated copies of the budget review. Action: ALL to review budget in preparation for discussion at next meeting.

It was agreed to add DL as an additional signatory to the Parish Council Bank Accounts following resignation of J Goddard.

16. Planning:
- Applications
10/02103/HOUSE - Plum Cottage, 19 Midgham Green. - Midgham Parish Council support the above application subject to the following comments:
1. That the garage needs to be set back from the entrance boundary to allow 5m clear distance to the front of the garage doors in order to allow cars to park in front of the garage without obstructing the access track, which is a public footpath.
2. The garage site remains part of the curtilage of Plum Cottage
3. Construction vehicles do not park on or damage the Village Green
4. That the proposed height is not exceeded.
5. There are concerns that this may be overdevelopment and the garage is out of character with the location.

10/02095/FULMAJ - Highcroft Kennels, Bath Road, Midgham Midgham Council objected to the application and returned the following comments:
1. It appears that the proposal is for a double garage rather than a machine store.
2. This is considered as overdevelopment
3. Does not comply with planning policies ENV1 & ENV20
4. A similar application was received a few years ago and refused.

10/02540/MINMAJ - New Industrial Unit, Colthrop Business Park - OBJECTION - Midgham Parish Council does not support this blanket removal of the conditions as listed in the application -

Minutes of the Parish Council meeting held on Tuesday 28th September 2010 in the Village Hall at 7.30pm.

Present were Mr H Long (Chairman)(HL), Mrs I Neill (District Councillor) (IN)

11 members of the public including Heather Hutchins (Flood Warden), Dr John Raban (The Chapel Row Community Service Group).

1. Apologies for absence were received from Mrs M Rusbridge (MR) due to other commitments.
2. Declarations of interest – None
3. Minutes of the previous meeting held on Tuesday 20h July 2010 and 7 Sept 2010 were approved and signed.
4. Matters arising
- Midgham Community First Responder Scheme - Request for donation of £500 was agreed. Also suggested charity tin in local pubs etc. ACTION: Clerk to investigate and raise cheque
- Village Green – It was agreed to accept the proposal from Weeds and Seeds.
ACTION: Clerk to contact Mr Awbery and establish whether he has public liability insurance.
- Brimpton Road update – Heather Hutchins reported that situation sorted – ditch dug, gullies emptied & taken away. It was noted that WBC had responded promptly. It remains the landowners responsibility to clear ditches and WBC to ensure it happens. It was agreed to review in May/June to make sure this work is done annually.

5. Emergency Planning – Chairman welcomed and thanked Carolyn Murison of West Berks Council – detailed discussion took place.
Key points:
- WBC look to parish responsibility/help for localised issues
- Main potential risks are snow/sustained cold weather/flash flooding/transport A4 and rail/infectious diseases – the risks of these are small but impact at time big especially to vulnerable
- WBC have a template but not suitable to a small community – Midgham needs a focused workable plan for it to be effective – KEEP IT SIMPLE!
- the key is knowing who can help and who can’t cope
- reference was made to the WBC website as a first point of contact in emergencies which uses a traffic light warning system
- Question from public re potential disaster at AWE – established plan is on website for reference
Plan should incorporate: Key risks / key contacts / Parish Map #1 – marking key areas/risks e.g. flood points, gullies etc. / Parish map #2 (secured and confidential but accessible) marking vulnerable people.
- it was agreed a sensible approach to split the parish into wards and appoint responsible wardens incorporating both parish councillors plus community members
Considerations – personal risk if helping / wardens may have personal problems eg flooding and be unavailable to help / payment to helpers, this issue is being looked into at present (Melvin May @ WBC) – clerk to monitor
Identify: potential evacuation points/ communication points/ available resources /links to existing social care groups – doctors/nurses/willing residents/equiptment tractors, snow ploughs, 4x4’s / overlap with ‘The Chapel Row Community Service Group (contacts: Dr John Raban & Georgina Cardy)
ACTION: Next Steps: Appoint ward members when we have a full council – Clerk to agenda
Look at Aldermaston Parish Council plan (in draft stages) for ideas – Clerk to obtain copy




6. District Councillor’s report – report to follow
Irene Neill was asked to investigate- Allison Prudden took names at the meeting she attended but no follow up.

7. Village Hall – Vivienne Davis reported: a management committee had been appointed - Mike Berry has handed over as treasurer - June Dutton is continuing in her role as a trustee.The new trustees are:

A formal letter inviting the Parish Council and the Parochial Church Council to appoint a member as a trustee will be sent to the Chairman with a reply requested within 28 days. The locks to the hall are to be changed and key procedures will be introduced.

The clerk returned the outstanding cleaning money in respect of cleaning the village hall to V Davis.

8. Resignation of councillors and vacancy for a new councillor – Clerk advised that James Ormrod and John Goddard had resigned from the council and 2 vacancies were to be advertised in accordance with the guidelines. The 14 day period in which applicants can advise the returning officer at WBC started on 27 September.

9. Nursery Copse Appeal –the matter is being pursued by legal team at WBC. A meeting is to be held 18 Oct. Irene Neill will report back. ACTION : Clerk to monitor progress

10. Public Time
In the absence of MR the clerk read out an issue raised re encroachment into agricultural land at Midgham Park. These are:
1. Midgham Park Farm - creation of fenced off gravelled area at top of field
2. West Lodge - garden extended beyond boundary
3. Gardeners Cottage - use of agricultural land as garden
The enforcement officer needs to be contacted but it was agreed to discuss this in more detail when M Rusbridge was present at the next meeting. Subsequently DL requested the details to investigate further. ACTION: Add to agenda for October meeting

Ray Disson (ex chairman) advised that Midgham domain name is up for renewal at cost of £30 – Ray was happy to arrange this. ACTION: Clerk to arrange to reimburse

Additionally the Chairman advised that the Parish Council would be receiving a letter from Tony Hodges regarding Toad Hall Sewerage system – which involves encroachment onto the village green. It was agreed to await further communication.

11. Clerks’ report:
Clerk advised that the External Audit of annual accounts was now completed with minor comments. These would be displayed on the notice boards in accordance with guidelines.

Minutes of the extraordinary Parish Council meeting held on Tuesday 7 September 2010 in the Village Hall at 7.30pm to discuss pending planning applications and outstanding payments.

Present were Mr H Long (Chairman) (HL), Mrs M Rusbridge (MR), Mr D Lombardo (DL), Mr J Carey, the Clerk Mrs A Spoor and 5 members of the public.

1. Apologies for absence were received from J Ormrod. Mr J Goddard was unable to attend following an accident prior to the meeting.

2. Declarations of interest – Mr J Carey declared an interest that he was a personal friend of the Harpers re Hall Court Planning Application and Mr H Long declared that he was neighbour to the Harpers.

HL has reviewed the application with the applicant Mr Harper and understands the intention to restore many of the original Queen Ann/William Mary period features of the house which have been eroded over the years. It is felt that the proposed extension to the stable block will be barely noticeable and therefore the parish council feel no reason to object. No objections were submitted.

MIDGHAM PARISH COUNCIL

Minutes of the Parish Council meeting held on Tuesday 20th July 2010 in the Village Hall at 7.30pm.

Present were Mr H Long (Chairman)(HL), Mrs M Rusbridge (MR), Mr D Lombardo (DL), Mr J Goddard, the Clerk Mrs A Spoor and 5 members of the public.

1. Apologies for absence were received from J Carey and I Neill due to other commitments. J Ormrod did not attend.

2. Declarations of interest – Mr Lombardo declared an interest that is his son was involved with the discussions re the Village Hall.

3. Minutes of the previous meeting held on Tuesday 29h June 2010 were read, approved and signed.
4. Matters arising:
4.1 Fire proof safe for clerk to store valuable records – spend up to £150 was agreed
4.2 DL advised that Woolhampton football pitch (beyond the Rowbarge) is being leased from Wasing Estate and that it would be alright for Midgham residents to play there.
Action: Clerk to advise Mrs Hutchins

5. District Councillor’s report - the District Councillor was not present.

6. Brimpton Road – Mr Pettifer presented photos of Brimpton Road clearly showing the need for maintenance cutting back greenery to improve line of sight for drivers on the corner.
Action : Clerk to contact WBC re cutting of grass.

Clerk updated progress re potential flooding issue being dealt with by J Winstanley of WBC - advised that landowner has been contacted and is in discussions re clearing the ditch. Staceys (who are responsible for the gravel extraction works) are also being asked to cut a path through the bund. Discussion re availability of space behind the ditch to allow clearing of ditch – parish council agreed to watch issue closely and bring pressure on WBC if necessary.
Action: Clerk to raise issue of grass cutting with WBC and monitor progress

7. Nursery Copse Appeal – clerk updated - WBC have agreed to meet with Midgham parish councillors but are awaiting clarification from the legal representatives. WBC will make contact when in a position to speak.
Action: Clerk to monitor

8. Emergency Planning – Carolyn Murison of WBC is attending the September parish council meeting. Articles have been put in the Church magazine in August and September to invite residents to attend.
In preparation of the meeting it was agreed:
• to review the current split of the parish into wards and have 2 lists one for planning where the councillor is not resident and one for other purposes where the councillor is resident
• see how the booklet recently distributed to all households could be used

9. Public Time – Village Hall – see below item

Water leak opposite Midgham Park appears to have stopped. There is a constant water leak outside the Almshouses and also Nursery Copse
Action: Clerk to report to Thames Water

10. Village Hall:

MR advised that she had received email regarding membership of the Village hall but that due to holiday commitments the trustees had not had opportunity to meet. Mrs V Davis presented a list of questions re the Village Hall Charity. As this is Village Hall business not Parish Council it was resolved that the list of questions be put to MR in writing and copied to the clerk. MR provided a copy of the transcript of Conveyance which serves as the constitution – and advised that the original is held by the clerk - it was possible to make an appointment with the clerk to view this document if required. Derek Lombardo declared an interest as his son was involved with the Village Hall plans. MR advised that she would be unable to action anything in the following week due to prior commitments.

15. Midgham Green:

Cutting of the Green/contract for work – Mrs Wright offered to get the Green cut by her contractor
Action: Clerk to contact Mrs Wright re payment HL/DL to investigate re future frequency of cutting

16. Other business
HL advised that a more substantial log had been placed at the entrance to the woodland below Mr Inwoods property.
